Agnes Smith’s Will 1903

Agnes Smith was the second daughter of John Smith of Melmerby. She died at the age of 46 and left her property to her two sisters Hannah and Mary Ann as well as giving small bequests to the daughters of her brother George Hardy Smith.

This is the last Will and Testament of me Agnes Smith of Number 94 Lowther Street, Penrith in the County of Cumberland, Spinster

  1. I bequeath to my sister Hannah Smith and my nieces Elinor, wife of James Beaty, and Sarah Agnes Smith each the Legacy of One hundred pounds
  2. I devise and bequeath all my Real Estate and the residue of my Personal Estate unto and to the use of my sisters Hannah Smith and Mary Ann Smith their heirs executors administrators and assigns in equal shares as Tenants in Common
  3. I appoint my said Sisters Executrixes of this my Will

In witness whereof I have hereunto set my hand this ninth day of March One thousand nine hundred and three    Agnes Smith

Signed and declared by the said Agnes Smith the Testatrix as and for her last Will and Testament in the presence of us, present at the same time, who at her request in her presence and in the presence of each other have hereunto subscribed our names as witnesses    Tom Lamonby     Lawrence Lamonby

On the sixth day of May 1903 Probate of this Will was granted at Carlisle to Hannah Smith and Mary Ann Smith the Executrixes
